Renewed Threats to Net Neutrality: Our Ongoing Commitment to an Open Internet
The open internet is under fire yet again. In a recent ruling, the Sixth Circuit Court of Appeals struck down the Federal Communications Commission’s (FCC) attempt to reinstate net neutrality rules. According to the court, internet service providers (ISPs) are classified as offering an “information service” rather than a “telecommunications service” under the Communications Act of 1934. Consequently, the FCC lacks the legal authority to impose net neutrality regulations, as it would with common carriers.
For many Americans, this development raises concerns that ISPs could limit internet freedom by throttling speeds, blocking certain websites, or introducing “pay-to-play” pricing tiers. The heart of net neutrality is the principle that everyone should enjoy the same online experience—unfettered access to information, communication, and innovation.
Former FCC Chairman Tom Wheeler has described net neutrality as an “age-old proposition,” reminding us that we are dealing with a fundamental public interest: whether the companies controlling today’s most powerful communication platform must adhere to “just and reasonable” standards. Despite the latest legal setback, the spirit of net neutrality remains very much alive for everyday internet users and those who believe in equal access to the digital world.
